Our General Terms and Conditions of Sale aim to provide you a greater awareness of your rights as a customer; please read carefully the below information.
These Terms and Conditions of Sale set out the conditions that apply to the purchase of goods of the company AD TYRES INTERNATIONAL SLU – referred hereinafter as «AD TYRES INTERNATIONAL SLU» or the «Company» - incorporated under the laws of Andorra and registered with the address of C. Prat de la Creu, 59-65, AD500 Andorra la Vella in Andorra with a capital of 1.000.000 EUR under the registration number NRT : L-711448-M Recording Date : 30/05/2016 at the Registration Office of Commerce.
Any private person or business entity making a purchase on the website of the Company will be referred to hereinafter as «Customer» or «Buyer».
These General Terms and Conditions of Sale constitute an agreement between AD TYRES INTERNATIONAL SLU and the Customer.
The website www.tyreleader.ie is freely accessible to all. It has been created to sell tyres, wheels and snow chains to private persons and business entities. The detailed description of these products can be found on the website.
These General Terms and Conditions define the rights and obligations of the Company and the Customer in the act of the online purchase of the products proposed by the Company. The Customer must refer to The General Terms and Conditions of Sale that can be found on the website at the moment of the Customer’s validation of order.
The present General Terms and Conditions of Sale applies to all sale of products via the website of the Company, by using the website the Customer these General Terms and Conditions of Sale and thus enters into agreement with the Company. The Company reserves the right to modify the present General Terms and Conditions of Sale by publishing a new version on the website at any moment. The applicable General Terms and Conditions of Sale is then the one published on the website at the moment of the payment of the order.

The Company ensures that for all orders placed on the website there is a validation possibility before the order is placed. The Customer declares having read and accepted fully the present General Terms and Conditions of Sale.
According to the Irish law the Customer declares being fully eligible to represent the private person or business entity he/she is acting for. The information registered by the Company constitutes the proof of all transactions unless proved otherwise.
All claims must be sent to the Customer Service. The commercial service of AD TYRES INTERNATIONAL SLU cannot handle claims.

The price of the products on our website is indicated in euro with all taxes included and is detailed fully on the page of the product itself.
In accordance with Section 16 hereunder, any order is subject to Andorran law. These orders are deemed processed in the territory where AD TYRES INTERNATIONAL SLU is established. As a consequence, prices applicable to the products may include environmental contribution requited by the State of Andorra.
In case the VAT is modified by the Irish authorities the Company adjusts the prices of the products accordingly.
At the moment of purchase prices are displayed in euro in the shopping cart with all taxes included.
The price of the products changes several times a day. The prices displayed on the website may be modified at any time and without notice. However, such modifications will not affect any orders that the Customer have already placed previous to modifications.
AD TYRES INTERNATIONAL SLU agrees to apply the price indicated on the website at the moment of the validation of the order. Telecommunication costs necessary for the access of the website of AD TYRES INTERNATIONAL SLU are to be paid by the Customer. The same applies to the shipping costs, too.
The characteristics and the price of the products can be viewed by the Customer on the website of the Company.
Certain information, such as images of the products or the information displayed on the quality and performance rating labels are non-contractual; AD TYRES INTERNATIONAL SLU cannot be held responsible if the ordered product or the information on its quality and performance rating label is different from the image shown on the website.
The DOT refers to the date of manufacture of the tyre. It is a four-digit number indicating the week and year of the date of manufacture. All tyres manufactured less than 36 months ago are considered as new. No claim can be accepted by AD TYRES INTERNATIONAL SLU for tyres manufactured within the last 36 months.
The Customer acknowledges having been informed about the shipping fees, the payment and the delivery conditions.
AD TYRES INTERNATIONAL SLU honours the order of the Customer within the limits of availability in stock. In case a certain item is out of stock AD TYRES INTERNATIONAL SLU will inform the Customer about it.
This order information is then communicated in details to the Customer in English upon confirmation of the order and thus creating the agreement between the Company and the Customer. A summary and a confirmation is sent to the Customer upon confirmation of the order.
It is agreed and indicated under each image on our website that pictures are non-contractual. AD TYRES INTERNATIONAL SLU cannot be held responsible if the ordered product is different from the image shown on the website.
Except under special conditions, the rights granted hereunder are only to the physical person signing the order (or the owner of the email address provided).
In accordance with legal terms regarding compliances and hidden defects, AD TYRES INTERNATIONAL SLU refunds or exchanges defective or not corresponding products in orders.
The refund can be requested by the following methods:
AD TYRES INTERNATIONAL SLU organises the return of the defective products at his own expense and agrees to fully refund the Customer within 10 working days starting from the moment the product is returned to the warehouse. The full refund is subject to the result of the expert evaluation and can be processed if the evaluation reveals a defect favouring the Customer.
The refund will be always processed using the same means of payment as the order was made (bank card, bank transfer, etc.)
It happens that certain manufacturers sell their product under a different brand name. It is the case for example for the tyres Maxxis and Cheng Shin and CST, which are three brands manufactured by the same company: Cheng Shin / CST. It is also the case for the brands Mitas and Sava. These tyres are manufactured by the same company and therefore have the same quality and performance. AD TYRES INTERNATIONAL SLU cannot know in advance which tyre brand will be delivered for an order of one of these brand tyres.
If the Customer decides to return the tyre, the return shipping fees are consequently to be paid entirely by him/her.
If AD TYRES INTERNATIONAL SLU organizes the return of the products the return shipping fee is 25€ per item (per ordered article) in case the collection of the item(s) is carried out by a professional carrier.
The customer may decide to return the items at his/her own expenses. In this case the Customer must ask for a valid return address from AD TYRES INTERNATIONAL SLU and the return shipping will be entirely his/her responsibility. AD TYRES INTERNATIONAL SLU will provide the Customer with a return document to attach to the parcel(s). AD TYRES INTERNATIONAL SLU cannot be held liable for any damage or loss during the return transport. The Customer will receive a full refund within 10 working days starting from the moment the product is returned to the warehouse.
The refund will be always processed using the same means of payment as the order (bank card, bank transfer, etc.)
The Products become the property of the Customer upon validation of the Order. Consequently, the Customer is solely responsible for the importation and introduction of the Products into the destination country he has chosen for shipment. The Customer is invited to consult the possible obligations incumbent on him due to the importation of the Products into the said country of destination.
Any risk of loss or damage to the Products is transferred to the Professional Customer or Non-Professional Customer from the transfer of ownership.
Any risk of loss or damage to the Products is transferred to the Consumer Customer when the latter or a third party designated by him, and other than the carrier proposed by the Seller, takes physical possession of the Products.
The delivery in general takes place between 2 and 8 working days. We cannot guarantee shipping times. It happens that a parcel is delayed due to traffic issues or accidents during transport. A delivery time limit is set to 30 days after reception of the payment. Having passed this time limit the Customer can be reimbursed by simply requesting the cancellation of his/her order.
If the delivery address is a fitting centre, it is the Customer’s responsibility to contact directly this fitting centre in order to make an appointment and to verify availability.
The shipping fees are offered in the case of an order of two identical products.
In case one item is ordered (car tyre, rim) the shipping fees are to be paid by the Customer unless the order concerns motorcycle tyres or in certain cases where the shipping fee is offered for the purchase of at least one tyre.
AD TYRES INTERNATIONAL SLU agrees to deliver the products to the delivery address provided by the Customer during the placement of the order.
If the order contains several different items, it is possible that these different items are not delivered the same day therefore no claim can be accepted from the Customer in these cases.
AD TYRES INTERNATIONAL SLU cannot be held responsible if the Customer provided incomplete or incorrect delivery address which then results in the impossibility of delivering the products. In that case the return shipping fee of 25€ per parcel will be entirely charged to the Customer.
If the Customer is absent when the delivery takes place, the Customer must contact the transporter in charge of his/her parcel in order to arrange a new delivery date or to obtain the address of the depot where the Customer’s parcel is stored by the transporter.
Should the Customer fail to complete the above actions the parcel will be returned to the warehouse of AD TYRES INTERNATIONAL SLU within 10 working days and the return shipping fees will be charged to the Customer. Upon return of the items to the warehouse the refund will be processed to the Customer with the deduction of the return shipping fee of 25€ per parcel.
All loss or damage of the product is the responsibility of the Customer from the moment the Customer accepts delivery of the product.
The Customer must either inform the transporter about all issues in writing at the time of delivery or refuse delivery with a reason given.
The Customer must verify the state and conformity of the delivered product at the time of delivery both in case the delivery takes place at a home address or at a fitting centre.
If the delivered product does not correspond to the ordered item or the parcel is delivered damaged, the Customer has to refuse delivery. The Customer then must immediately inform AD TYRES INTERNATIONAL SLU about it by contacting the Customer Service of the Company via the ticketing system or by sending a fax or a letter (AD TYRES INTERNATIONAL SLU C. Prat de la Creu, 59-65, AD500 Andorra la Vella, Andorra).
AD TYRES INTERNATIONAL SLU will not take back any items already fitted or used.
In case the Customer contests the signature on the delivery, a claim will be filed with the transporter company. A certificate of non-reception will be sent to the Customer which must be returned dated and signed by the Customer in order to be able to hand in the claim to the transporter company. If the delivery address took place at a fitting centre the Customer must ask the fitting centre to sign the certificate.
The deadline for the handling of the claim is minimum 10 working days from the date the claim is filed and it can take up to 4 weeks to receive the reply from the transporter company. This deadline is set by the transporter company, AD TYRES INTERNATIONAL SLU cannot be held responsible for any delay.
If the Customer chooses one of the partner fitting centres of the Company as delivery address, he/she agrees to have the tyres fitted in the chosen fitting centre. The fitting prices are set by the fitting centre and not by AD TYRES INTERNATIONAL SLU and the Customer has to accept these prices. If the Customer refuses to fit the tyres at the fitting centre where the delivery of the order took place, the fitting centre has the right to request a reasonable amount of payment from the Customer for the reception and storage of the Customer’s tyres.
The Company cannot be held responsible for the services of the fitting, balancing or other services of the fitting centres where the Customer ordered the tyres as the fitting centres are not related in any way to the Company. The business relationship between the fitting centre and the Customer is subject of an agreement between the fitting centre and the Customer.
The information concerning the fitting centres such as opening hours, prices and services, the maximum dimension fitting size, etc., are provided by the fitting centres. AD TYRES INTERNATIONAL SLU cannot be held responsible if the prices or opening hours of the fitting centres displayed on the website are different from the actual prices or opening hours. It is the responsibility of the Customer to contact the fitting centre chosen for delivery and ask for prices and availability before the order is placed.
This information can be modified on the website without the knowledge of AD TYRES INTERNATIONAL SLU.
The stock and prices are automatically modified on the website several times a day. AD TYRES INTERNATIONAL SLU will honour the order of the Customer within the limits of the available stock. In case the product is out of stock AD TYRES INTERNATIONAL SLU informs the Customer immediately about it and fully reimburses the Customer via the same means as the order was paid originally.
Our Customer Service is available via the contact form for commercial questions or via the ticketing system for questions related to after-sale service of orders.
In order to connect to his/her account the Customer must use the same email address as what he/she used during the placement of the order with the password chosen during the order.
Our After-sale Service is open from 08:00 to 16:00 (except weekends and bank holidays).

AD TYRES INTERNATIONAL SLU has the possibility to request cancellation of the order after validation of the payment.
AD TYRES INTERNATIONAL SLU agrees to respond to cancellation requests and execute those requests but cannot be held responsible if the cancellation attempt fails. Once the items are being held by the transporter, it is impossible to cancel or stop the order’s shipping.
If the cancellation is validated the Customer receives a confirmation about it from the Company and the refund is processed within 10 working days via the same means of payment as the order was paid originally
In case the order cannot be cancelled the Customer has the possibility to refuse delivery. Upon return of the items to the warehouse of AD TYRES INTERNATIONAL SLU the refund will be processed with a deduction of the return shipping fee of 25€ per parcel.
If the Customer accepts delivery, AD TYRES INTERNATIONAL SLU can organise the return of the products. The return shipping fee in this case is 25€ per item, so 25€ per tyre, rim or snow chain.
The Customer can decide to return the items at his/her own expenses. In this case the Customer must inform AD TYRES INTERNATIONAL SLU in order to obtain the return address where the products must be sent back. In this case the Customer takes full responsibility of the transport until the point where the product arrives to the warehouse of AD TYRES INTERNATIONAL SLU. The Company cannot be held responsible for a loss or damage during the return shipping. Once the product is returned to the warehouse AD TYRES INTERNATIONAL SLU processes the full refund within 10 working days.
Payment must be made immediately at the placement of the order. The Customer can pay by bank card, PayPal or by bank transfer.
The Customer must state the order number on the payment form if the payment is made by bank transfer. AD TYRES INTERNATIONAL SLU can identify the order with this order number. As soon as the bank transfer payment arrives (it can take up to 72 hours) the order is validated and the product is shipped to the Customer.
The Customer will receive an e-mail confirmation about it.
All bank cards issued by bank institutions outside Ireland must be international bank cards (Mastercard or Visa). The secured online bank card payment is carried out by a provider.
All payment processes made between the individual customers and the HIPAY/BRAINTREE/CHECKOUT payment system are fully encrypted and protected. The protocol used for the payment is SSL registered to the electronic banking (3D Secure protocol).
All information concerning the order and the bank card number is protected and does not appear on the Internet. The bank card number is never printed to any document, invoice or other paper.
AD TYRES INTERNATIONAL SLU does not know the bank card numbers. The HIPAY/BRAINTREE/CHECKOUT system does not keep the bank card numbers once the payment transaction is forwarded to the bank. Thus no one has access to the bank card details of the Customer via informatics or printed documents. The risk of hacking and obtaining the Customer’s bank card number during a purchase action on the websites of AD TYRES INTERNATIONAL SLU via the HIPAY/BRAINTREE/CHECKOUT system is zero.
Professional Customers can make their payments by bank cards or by using the automatic debiting system of AD TYRES INTERNATIONAL SLU.
The payment transaction confirmed by the Customer is immediately debited on his/her account. In accordance with Article L. 132-2 of the Monetary and Financial Code, the commitment of payment by bank card is irrevocable. By providing his/her bank card details during the payment process the Customer authorizes AD TYRES INTERNATIONAL SLU to debit his/her card with the amount corresponding to the indicated price. The Customer confirms that he/she is indeed the legal owner of the debited card and he/she does have the right to use this card. In case of an error or the impossibility to debit the card the order is immediately cancelled.
The activities related to the distance selling contract are held by AD TYRES INTERNATIONAL EU located Level 3 Suite No. 2407, Tower Business Center, Tower Street Swatar, BIRKIRKARA BKR 4013, MALTA - company registration number OC 1277.

In case of rejection of your payment, we give you 7 days to regularize your situation without interest on arrears while retaining the right to benefit from your « ease of payments ». After this period, you will lose the right to benefit from the « ease of payments » and all amounts will become immediately due. Interest for late payment will be calculated, from the date of your order, at the ECB rate plus 10 points, without prior notice.
The Customer has a right of cancellation that he/she can exercise without giving any reason or paying any penalties – except for the payment of the return shipping fees - for a period of 14 days starting from the day of receipt of any goods ordered on the website.
In order to exercise the right of cancellation, the Customer must inform the Company in writing, in a clearly worded statement within 14 days from the receipt of the relevant good. The Customer can open a ticket in the relevant order in order to contact the After-sale Service or can send a fax or a letter (AD TYRES INTERNATIONAL SLU C. Prat de la Creu, 59-65, AD500 Andorra la Vella, Andorra).
The Customer shall bear all costs of returning the goods when exercising his/her right of cancellation, only the price of the purchased product and the shipping costs will be fully refunded.
The Company is unable to take back any fitted wheel, except if the delivery is refused due to damage during transport.
The products must be returned in their original packaging unused and undamaged.
The return shipping fees are always deducted from the final refund of the order.
The products can be returned on the following ways
AD TYRES INTERNATIONAL SLU is in the legal duty to provide guarantees for legal compliances and hidden defects.
The Customer benefits of the warranty during two years counting from the date of delivery. He/she can choose to receive a replacement or to be reimbursed; the replacement is subject to availability. The Customer has the right to request an expert evaluation of a tyre if he/she finds it faulty.
This tyre will be compulsorily sent back to the manufacturer for expert evaluation. The return transport is the responsibility of AD TYRES INTERNATIONAL SLU.
The expert evaluation can take up to several months (minimum 3 months). During this period the Company cannot send a replacement to the Customer or refund him/her without the results of the expert evaluation.
Once the expert evaluation is done the Customer will receive the expert evaluation report informing him/her about the result. No claim can be taken into account after reception of the results.
If the expert evaluation reveals a fault then the Customer will be refunded, otherwise the Company will have to invoice the Customer for the costs of the evaluation which is 35€ per tyre.
The Customer will be reimbursed through the same means of payment as the order was paid.
If the result of the expert evaluation is negative, the tyre in question will be either destroyed or returned to the Customer.
AD TYRES INTERNATIONAL SLU guarantees to all its Customers that the products are conform to the European legislations and are approved for driving on road (except if otherwise indicated on the website, for example for quad tyres).
The Customer has to make sure that the purchased tyres and rims comply with the manufacturer’s description of his/her vehicle.
The Customer must respect the manufacturer’s description and recommendation regarding security and reliability of the vehicle, especially for the size of tyres and rims, inflation and tire pressure, and the conditions of installation and storage of tyres.
AD TYRES INTERNATIONAL SLU cannot be in any case held responsible for the choice the Customer makes when purchasing a product, for incorrect storage or for the use of the product under incorrect conditions. The Customer has to make sure the ordered products are compatible with his/her vehicle and are conform to the manufacturer’s description and recommendation.
The guarantee does not cover damages due to incorrect fitting or normal wear of the tyres or the consequences caused by improper use of the products or the deterioration of products because of negligence.
AD TYRES INTERNATIONAL SLU does not provide supplementary guarantee other than the legal guarantees for legal compliance and hidden defects.
The Company cannot be held responsible for the services of the fitting, balancing or other services of the fitting centres where the Customer ordered the tyres as the fitting centres are not related in any way to the Company. The business relationship between the fitting centre and the Customer is subject of an agreement between the fitting centre and the Customer.
All information related to intellectual property rights such as brands, products, domain names, images, videos, texts, etc. are the intellectual property of AD TYRES INTERNATIONAL SLU.
No assignment of intellectual property rights is conducted through the present General Terms and Conditions of Sale.
These goods are the exclusive property of AD TYRES INTERNATIONAL SLU and may not be used or reproduced in whole or part without prior authorization.
On the occurrence of an unforeseen event or force majeure which prevents AD TYRES INTERNATIONAL SLU from fulfilling its obligation toward the Customer, this obligation will be suspended. AD TYRES INTERNATIONAL SLU will inform the Customer of the occurrence of such an event as soon as possible.
AD TYRES INTERNATIONAL SLU is committed to protect the personal date of the users of the tyreleader.ie website. All personal information is sent and stored securely at the website’s maintainer in France. AD TYRES INTERNATIONAL SLU may need to collect personal data about the users of its site and transfer them to its partners.
In accordance with the Irish Data Protection Act (as amended), Customers have a right to access, rectify and delete Personal Data (as defined in the Data Protection Act), or to object to its processing. Customers can do this by sending a letter to the below address:

Contractual relations between the Seller and the Consumer Client located within the territory of the European Union are governed by the law of the Member State in which the latter is established with regard to its protection under that Member State’s consumer law.
Being that the data relating to the Order is processed by the Seller's Maltese location, Maltese law shall apply to the processing of personal data.
In all other matters not covered by the above two stipulations, Andorran law shall be applied.
